Awaab's Law & Landlord Obligations
Awaab's Law — named after two-year-old Awaab Ishak, who died in 2020 as a direct result of prolonged exposure to mould in a social housing property — represents a landmark shift in how damp and mould is treated in law. The legislation, introduced through the Social Housing (Regulation) Act 2023, places strict timeframes on social landlords to investigate and fix damp and mould hazards.
While Awaab's Law currently applies to social housing in England, the principles are influencing wider housing standards across the UK, including Northern Ireland. Private landlords in Northern Ireland are already required under the Fitness for Human Habitation standard to ensure properties are free from serious damp and mould hazards. Failure to act on a reported damp or mould problem can result in enforcement action by the local council, rent repayment orders, or civil claims from tenants.
